Following review by the Administrative Appeals Tribunal (AAT), it was decided by consent that the following conditions be imposed on the applicant's registration:
(1) the applicant must send quarterly reports to ASQA on the trainers and assessors nominated to deliver the training products on their scope of registration; and
(a) a copy of the trainer/assessor's current CV;
(b) evidence of the trainer/assessor's:
- vocational competencies up to the level being delivered and assessed
- current industry skills relevant to the training and assessment being provided
- current knowledge and skills in vocational training and learning that informs their training and assessment
- credential specified in Item 1 or Item 2 or Item 3 of Schedule 1 of the Standards for Registered Training Organisations 2015 for training and assessment delivered on or prior to 31 March 2019
- credential specified in item 2 or item 3 of schedule 1 if delivered on or after 1 April 2019
(c) and every six months, provide to ASQA statutory declarations detailing the trainer and assessor's employment with other RTO's;
(2) the applicant must retain and present to ASQA on request all completed student assessment material for all VET students for all VET courses for two (2) years commencing on the date on which a student is issued with a qualification;
(3) the applicant must retain a quarterly register of workplaces used to deliver training and assessment in relevant courses on scope, and must provide this register to ASQA on request, including the following details:
(a) name of workplace;
(b) address and contact details of workplace;
(c) course code(s) and title(s) delivered at the workplace;
(d) trainer(s) and assessor(s) assigned to deliver at the workplace;
(e) details of students undertaking training at the workplace including:
- student name;
- date of birth;
- student USI;
- period of training at the workplace; and
(f) a sample of photo and video evidence of the facilities while in use;
(5) the applicant, a registered provider, must maintain and produce on request to ASQA, class rolls for each class, containing the name of each student scheduled to attend that class, signed by each student who did attend that class at the commencement and ceasing of each class and signed by each trainer/assessor training or assessing in that class for all VET courses.
