Fit and Proper Person Requirements Declaration
The National Vocational Education and Training Regulator (Compliance Standards for NVR Registered Training Organisations and Fit and Proper Person Requirements) Instrument 2025 is now in effect. This includes amendments to the Fit and Proper Person Requirements (FPPRs). Providers have an obligation to ensure that all staff involved in VET delivery meet the FPPRs.
The Fit and Proper Person Declaration must be completed by all governing persons as defined under the Instrument – that is:
- an executive officer of the RTO;
- a high managerial agent of the RTO; or
- any person responsible for overseeing, directing, or exercising a degree of control or influence over the management or operation of the RTO.
Providers may also be asked by ASQA to provide a declaration for any individual at any time.
All governing persons must submit a Fit and Proper Person Declaration whenever their RTO:
- applies for initial registration
- applies for renewal of registration, or
- employs/engages a new governing person.
Transition Arrangements from 1 July 2025
Governing persons are not required to submit a new (July 2025) version of the Fit and Proper Person Declaration to ASQA, unless:
- they are directly requested to do so by ASQA; or
- the RTO is submitting an application (e.g. for renewal) after 1 July 2025
- the governing person has never previously submitted a Fit and Proper Person Declaration to ASQA.
