The Commissioners decided to:

  1. Cancel, under the NVR Act s 36(2)(f) and s 39, the RTO’s registration with effect 35 calendar days after the date the RTO is given written notice of the decision.

Following AAT review, ASQA's decisions to cancel under the NVR Act is set aside, and in substitution, the Tribunal decides:

  1. Under section 36(2)(d) of the NVR Act, with effect from 1 October 2019, the items below are removed from the Applicant's scope:
    • BSB20115 - Certificate II in Business
    • BSB30115 - Certificate III in Business
    • BSB30415 - Certificate III in Business Administration
    • BSB40215 - Certificate IV in Business
    • BSB50215 - Diploma of Business
    • BSB51915 - Diploma of Leadership and Management
    • BSB51918 - Diploma of Leadership and Management
    • BSB61015 - Advanced Diploma of Leadership and Management
    • BSB80215 - Graduate Diploma of Strategic Leadership
    • SIT40516 - Certificate IV in Commercial Cookery
    • SIT40716 - Certificate IV in Patisserie
    • SIT50416 - Diploma of Hospitality Management
  2. The Applicant is directed under section 35A of the NVR Act to rectify each finding of non-compliance in ASQA's Evidence Analysis of 24 July 2019 and keep and retain evidence for inspection at any future compliance monitoring activity.
  3. The following conditions are imposed under section 29 of the NVR Act (subject to ASQA subsequently varying or removing the condition under section 29 of the NVR Act):
    • For every training and assessment activity conducted by the Applicant, for each student it must contemporaneously produce a record of:
      • the location,
      • the duration of the activity,
      • the identity of the trainer/assessor conducting the training or assessment activity; and,
      • a detailed description of the activity and any outcome;
    • The Applicant must retain and present to ASQA on request any completed pre-enrolment, enrolment, support and progression or training assessment records, for all VET students for all VET courses for a period of two (2) years from the date on which the student ceases to be a student;
      • All documents relating to each VET student must be stored, and be able to be produced, on request within 5 business days to ASQA;
      • For a period of two years:
        • Every 6 months the Applicant must create and store a signed statutory declaration by a director, certifying whether it currently complies with each clause of the Standards for RTOs and the basis on which they made that determination; and,
        • Every 6 months the Applicant must create and store the following information, a detailed description of:
          • how the Applicant ensures its operations are quality assured as required by clause 2.1 of the Standards for RTOs, including by detailing, its systems and processes and the implementation of those systems and processes to ensure it complies with each clause of the Standards for RTOs at all times; and
          • the progress of any compliance monitoring or quality assurance activity it has undertaken in relation to ensuring compliance with each clause of the Standards for RTOs in the preceding 6 months and that it has scheduled in the 6 months; and,
          • annex copies of any documents created, used or relied upon to monitor and/or ensure compliance and quality as referred to in that description.
