The Commissioner, Regulatory Operations decided to:

  1. Suspend, under s 36(2)(e) and s 38 of the NVR Act, the following part of the RTO’s scope of registration:
    • HLTAID003 Provide first aid
    • HLTAID004 Provide an emergency first aid response in an education and care setting
    • PUAWER004B Respond to workplace emergencies
    • PUAFER004 Respond to facility emergencies
    • PUAWER005B Operate as part of an emergency control organisation
    • PUAFER005 Operate as part of an emergency control organisation
      during the period of suspension, require, under NVR Act s 38(2), the RTO not to:
    • enrol a student in a suspended VET course or part of a suspended VET course
    • allow a VET student to begin a suspended VET course or part of a suspended VET course
    • publish or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course, or
    • cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course.

with effect 35 calendar days after the date the RTO is given written notice of the decision.

Additional information

Following AAT review, the parties reached an agreement on the following terms:

  1. ASQA will not suspend the following parts of the Applicant's scope of registration:
    • HLTAID003 Provide first aid
    • HLTAID004 Provide an emergency first aid response in an education and care setting.
  2. The Applicant will apply to remove the following parts from its scope of registration:
    • PUAWER004B Respond to workplace emergencies.
    • PUAFER004 Respond to facility emergencies.
    • PUAWER005B Operate as part of an emergency control organisation.
    • PUAFER005 Operate as part of an emergency control organisation.
  3. The Applicant undertakes to plan, implement and maintain professional development records for all trainers and assessors. The plan for each trainer will be for a period of at least 6 months in advance and records will be kept for the previous 12 months. These records will be maintained and produced during any regulatory activity.
