The RTO has sought review of the decision at the AAT.

On 22 January 2016, the AAT ordered a stay of this decision subject to the following text appearing on AIPE’s website:

Australian Institute of Professional Education Pty Ltd (AIPE) is a Registered Training Organisation within Australia that is subject to audit by Australia's national regulator, the Australian Skills Quality Authority (ASQA). AIPE is also registered to provide VET courses to overseas students.

ASQA regulates courses and training providers to ensure nationally approved quality standards are met including providers who provide VET courses to overseas students. Where standards are not met ASQA may decide to cancel the training provider's registration. This means the training provider will not be able to continue teaching any courses.

ASQA believes that AIPE does not meet certain standards and has taken the decision to cancel AIPE’s registration as a VET training provider, including its registration to deliver VET courses to overseas students.

AIPE believes it does meet all relevant standards and has challenged the decisions by ASQA to cancel its registration.

The challenge is currently before the Administrative Appeals Tribunal, being a body that provides independent review of administrative decisions by ASQA.

AIPE anticipates that the outcome of the Tribunal's review will be known within the next 4 to 6 months.

AIPE is entitled to continue to provide courses pending the Tribunal's decision.

Further to this, the AAT also ordered that the above statement is to be provided in writing to:

  1. all students applying for and offered enrolment in VET qualifications from 25 January 2016;
  2. all international students who have purchased a package of courses which includes a VET qualification and are currently studying at AIPE; and
  3. all other international students who have purchased a package of courses which includes a VET qualification at the time they commence their studies with AIPE.

On 4 November 2016, Deputy President Constance made an order to dismiss AIPE's applications pursuant to s 42A(1) of the AAT Act
