The Commissioners decided to:
- reject under the NVR Act s 17, the application for renewal of registration as an RTO in full.
The RTO applied to the Administrative Appeals Tribunal (AAT) for a review and stay of the decision.
The decisions have been stayed by the AAT pending determination of the review subject to the following conditions:
- The Applicant may enrol new students, up to a maximum of 400 students studying at any one time.
- The Applicant is to communicate to any new prospective student the following message in writing:
“AAMS is presently a registered RTO for the purposes of the NVR Act and ESOS Act. The Australian Skills Quality Authority, the regulator of VET colleges, is expected to make a decision regarding the renewal of AAMS's registration on or before 6 February 2021. AAMS conveys this information so that prospective students can make fully informed choices about their education options"
The AAT has remitted the decision back to ASQA for reconsideration. ASQA is required to affirm, vary or set aside the decisions 6 February 2021.
