  1. the decision under review, being a decision made by the Respondent on 18 May 2018 to cancel, under section 39 of the National Vocational Education and Training Regulator Act 2011 (Cth) (the NVR Act), the Applicant's registration as an NVR registered training organisation (RTO), is set aside;
  2. in substitution, the Applicant's registration is not cancelled.
