The Commissioner decided to:
i. impose, under the NVR Act s 29(1), the following conditions on the RTO's registration in relation to students in Western Australia:
- the RTO must retain and store copies of all completed student assessments for a period of 12 months from the date the student is issued with a competent outcome.
Where a student is subsequently issued with a full qualification, the completed assessments for the full qualification are to be retained for a period of not less than 12 months.
The records must be retained and stored by the RTO itself and not just at the premises of its third party; and
- the RTO must amend its third party agreements to ensure that third parties are obligated to provide the RTO with compies of all completed assessments for all units of competency, without exclusion, prior to the issuance of a qualification.
