Following AAT review, the parties reached an agreement.

The decision is set aside and in substitution:

1. the Applicant's registration is not cancelled
2. the following condition is imposed under s 29(1)of the NVR Act:
   • the Applicant cannot apply to increase its scope of registration or apply for CRICOS registration until it demonstrates implementation of its training and assessment practices for the previous 6 months, including a minimum sample of 10 completed student assessment files for each course on its scope of registration, or the total amount of student files if fewer than 10; and
   • for the remainder of its current registration the Applicant must retain all records of students’ assessments, including the master assessment tools, used to determine competency, for a period of 2 years from the date the decision of competency was made.​
