Following AAT review, the parties reached an agreement as to the terms of a decision of the Tribunal.

The Tribunal decides that:

  1. the decision to cancel under s 36(2)(f) of the NVR Act, is set aside and in substitution, it is decided that the Applicant's registration is not cancelled.
  2. Pursuant to section 35A of the NVR Act, the Applicant is hereby given a written direction requiring the Applicant to rectify all outstanding non-compliances identified in the Evidence Analysis Report dated 1 November 2019, within 20 days of the date of these orders and to retain evidence of these rectifications for inspection by the Respondent at the next regulatory activity.
