Following AAT review, the parties reached an agreement as to the terms of the Tribunal

The Tribunal decides that the cancellation decision is set aside, and in substitution for the cancellation decision:

1. the Applicant's registration under the NVR Act is reinstated for the period of its previous registration namely to 15 February 2023.
2. the following condition is imposed under section 29(1) of the NVR Act:
   1. commencing from the date of this decision, the Applicant must securely retain for two years, all completed student assessments for all students in all classes in all qualifications on its scope of registration, (per the definition in Australian Skills Quality Authority's General Direction – Retention requirements for completed student assessment items and clearly identifiable as to which student and unit/s each item relates to); and
   2. copies of the master assessment tools used for each assessment.
