​Following AAT review, the parties reached an agreement.

The decision to partially suspend the registration of International College of Excellence is set aside and in substitution:

1. the following conditions are imposed under subsection 29(1) of the NVR Act for the remaining period of International College of Excellence registration, which is due to expire on 16 January 2023:
   • International College of Excellence must securely retain, and provide to the Australian Skills Quality Authority (ASQA) on request, copies of all completed student assessment items for each student (per the definition in ASQA's General Direction – Retention requirements for completed student assessment items) and copies of the master assessment tools used for each assessment, for a period of 18 months from the date on which the judgement of competence for each relevant unit of competency is made;
   • International College of Excellence must not apply to add new courses to its scope of registration (with the exception of equivalent, superseding courses), unless it presents to ASQA at least ten (10) completed and marked student assessment files, where a VET qualification was issued for each file;
   • on or before 1 March 2021, International College of Excellence must engage a suitably qualified and independent consultant, on an ongoing basis, to review its internal governance, management systems and procedures to ensure International College of Excellence compliance with the Standards. On or before 1 October 2021, this review must be completed and a report prepared, with the assistance of the independent consultant, to be retained and presented to ASQA on request. The report must set out any recommendations, and actions taken as a result of such recommendations, including primary evidence of all documents referred to in the report.
