The Commissioners decided to:
i. cancel, under the NVR Act s 36(2)(f) and s 39, the RTO's registration with effect 35 calendar days after the date the RTO is given written notice of the decision;
Following AAT review, the parties reached an agreement.
The Tribunal set aside the decision and in substitution, made the following decisions:
- In accordance with the requirements of s 17 and s 18 of the NVR, the Respondent grants the Applicant's registration as an NVR RTO.
- In accordance with s 17(5) of the NRV Act, the period for which the Applicant is registered, to deliver the courses currently placed on its VET Scope of Registration, is determined to be 8 January 2020 to 23 September 2022.
- Pursuant to the requirements of s 29 of the NVR Act, the Applicant will:
- during the period of registration (from 8 January 2020 to 23 September 2022), retain in an identifiable and accessible format, either electronic or hard copies of completed Student Assessment Tasks for all units of competency for courses on its VET and CRICOS Scopes of Registration for an ongoing period of 18 months from their date of completion.
