Following reconsideration, ASQA decided to vary the decision to the following:

  1. Not suspend, under s 36(2)(e) and s 38 of the National Vocational Education and Training Regulator Act 2011 (NVR Act), the following parts of the RTO’s scope of registration:
    1. MSS40316 Certificate IV in Competitive Systems and Practices
    2. FBP30117 Certificate III in Food Processing
    3. and any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above.
  2. Give a written direction, under s 35A of the NVR Act, requiring the organisation to:
    1. rectify the breach of condition by addressing each remaining non-compliance detailed in the Evidence review report within 20 working days of the date of the notice; and
    2. retain evidence the written direction has been complied with for examination at a future regulatory activity.

ASQA decided to:

  1. Suspend, under s 36(2)(e) and s 38 of the National Vocational Education and Training Regulator Act 2011 (NVR Act), the following parts of the RTO’s scope of registration:
    1. MSS40316 Certificate IV in Competitive Systems and Practices
    2. FBP30117 Certificate III in Food Processing
    3. and any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above, and
    4. during the period of suspension, require, under s 38(2) of the NVR Act, the RTO not to:
      1. enrol a student in a suspended VET course or part of a suspended VET course
      2. allow a VET student to begin a suspended VET course or part of a suspended VET course
      3. publish or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course, or
      4. cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course.

with effect 35 calendar days after the date the RTO is given written notice of the decision.
