Following reconsideration, ASQA decided to affirm the decision.

The RTO applied to the Administrative Appeals Tribunal (AAT) for a review of the decision and following AAT review, the parties reached an agreement.

The Tribunal decided:

  1. to set aside the decision and in substitution, the Applicant's registration is not amended under the NVR Act.
