Following AAT review, the parties reached an agreement as to the terms of a decision of the Tribunal.

The Tribunal decides:

  1. That ASQA's decision to amend under the NVR Act the Applicant's scope of registration to remove the course 'TLI31216 Certificate III in Driving Operations', is set aside, and in substitution it is decided that the course 'TLI31216 Certificate III in Driving Operations' is not removed from the Applicant's scope of registration.

The Commissioners decided to:

  1. amend, under the NVR Act s 36(2)(d), the RTO’s scope of registration to remove:
    1. TLI31216 Certificate III in Driving Operations
    2. and any new training product that would be automatically added to the scope of registration because it is equivalent to one which appears above.

with effect 35 calendar days after the date the RTO is given written notice of the decision.
