The Commissioner, Regulatory Operations:

  1. suspend, under the NVR Act s 36(2)(e) and s 38, the following part of the RTO’s scope of registration:
    • CPP30411 Certificate III in Security Operations
    • RII30815 Certificate III in Civil Construction Plant Operations
    • RII30915 Certificate III in Civil Construction
    • AHCPMG304 Use firearms to humanely destroy animals
    • HLTAID001 Provide cardiopulmonary resuscitation
    • and any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above, and
    • during the period of suspension, require, under the NVR Act s 38(2), the RTO (not) to:
      • enrol a student in a suspended VET course or part of a suspended VET course
      • allow a VET student to begin a suspended VET course of part of a suspended VET course
      • publish or broadcast an advertisement relating to a suspended VET course or any
      • part of a suspended VET course, or
      • cause to be published or broadcast an advertisement relating to a suspended VET
      • course or any part of a suspended VET course.

with effect 35 calendar days after the date the RTO is given written notice of the decision.

Following AAT review, the parties reached an agreement.

The Tribunal decided the following:

  1. set aside the decision to suspend the following parts of the Applicant’s scope of registration:
    • CPP30411 Certificate III in Security Operations;
    • RII30815 Certificate III in Civil Construction Plant Operations;
    • RII30915 Certificate III in Civil Construction;
    • AHCPMG304 Use firearms to humanely destroy animals;
    • HLTAID001 Provide cardiopulmonary resuscitation; and
    • any new training package product that would be automatically added to the scope of registration because it is equivalent to one, which appears above.
  2. The course CPP30411 Certificate III in Security Operations is withdrawn from the Applicant’s scope of registration under s 33 of the NVR Act.
  3. In substitution to [1], the following conditions are imposed, under section 29(1) of the NVR Act, on the RTO's registration:
    1. Securely retain, and provide to ASQA on request, copies of all completed student assessment items for each student (per the definition in ASQA’s General Direction – Retention requirements for completed student assessment items) and copies of the master assessment tools used for each assessment, for a period of 18 months from the date on which the judgement of competence for each relevant unit of competency is made under section 29 of the NVR Act.
    2. Validate assessment materials, in accordance with clauses 1.9 and 1.11 of the Standards, for 20% of all training products on scope by 31 October 2020. Evidence of the validation process and outcomes must be retained to present to ASQA upon request between 1 November 2020 and 1 November 2021.
    3. Moderate ten (10) completed student assessment files, or otherwise 100% of completed student assessment files available, against the requirements of clauses 1.8 of the Standards, from each of the following training products on scope by 31 October 2020:
      • AHCPMG304 Use firearms to humanely destroy animals;
      • HLTAID001 Provide cardiopulmonary resuscitation;
      • RII30915 Certificate III in Civil Construction;
      • RII30815 Certificate III in Civil Construction Plant Operations;
      • SHB30115 Certificate III in Beauty Services;
      • 10618NAT Course in Firearms Safety (approved for Firearms Licensing in Queensland);
      • AHCPMG311 Use firearms for pest control activities from aircraft.

        Evidence of the moderation process and outcomes must be retained to present to ASQA upon request between 1 November 2020 and 1 November 2021.

  4. The RTO must provide ASQA, under section 26 of the NVR Act, a copy of its Australian Qualifications Framework Register within 28 days of ASQA’s request, with details of all student enrolments and testamurs issued for the preceding 24 months from the date of the request.
  5. ASQA may conduct a future compliance monitoring audit between 1 November 2022 and 1 November 2023, or alternatively a renewal of registration audit in 2024, to assess the RTO’s commitment to compliant training and assessment practices.

Note: The decision was stayed by the AAT for a period of 28 days from 11 November 2019 subject to following conditions:

  1. The Applicant must not enrol any students in, nor allow any student to commence studies for the following qualifications:
    • CPP30411 Certificate III in Security Operations;
    • RII30815 Certificate III in Civil Construction Plant Operations;
    • RII30915 Certificate III in Civil Construction.
  2. The Applicant may enrol any students in and allow any student to commence studies for the following qualifications:
    • AHCPMG304 Use firearms to humanely destroy animals;
    • HLTAID001 Provide cardiopulmonary resuscitation.
