The Commissioner, Regulatory Operations decided to:

  1. suspend under the NVR Act s 36(2) (e) and s 38,the following part of the RTO’s scope of registration:
    • BSB20115 Certificate II in Business
    • BSB30115- Certificate III in Business
    • BSB40215- Certificate IV in Business
    • BSB42615- Certificate IV in New Small Business
    • BSB51415- Diploma of Project Management
    • BSB51915- Diploma of Leadership and Management
    • CHC32015- Certificate III in Community Services
    • CHC33015- Certificate III in Individual Support
    • CHC43015- Certificate IV in Ageing Support
    • CHC52015- Diploma of Community Services§HLT54115- Diploma of Nursing
    • and any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above, and
    • during the period of suspension require under NVR Act s 38(2), the RTO not to:
      • enrol a student in a suspended VET course or part of a suspended VET course
      • allow a VET student to begin a suspended VET course or publish or broadcast an advertisement relating to a suspended VET course or any par tof a suspended VET course, or
      • cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course

with effect 35 days after the date the RTO is given written notice of the decision.

Review information

The provider applied to the Administrative Appeals Tribunal (AAT) for a review of the decision but the AAT subsequently dismissed the application on 19 December 2019 .

Note: The decision came into effect on 12 March 2019 and was subsequently stayed by the AAT from 28 March 2019 subject to the following

  1. That the Applicant not enrol a student in a Suspended VET Course or part of a Suspended VET Course or any new training package product that would be automatically added to the scope of registration because it is equivalent to a Suspended VET Course;
  2. That the Applicant not allow a VET student to begin a Suspended VET Course of any part of a Suspended VET Course;
  3. That the Applicant not publish or broadcast an advertisement relating to a Suspended VET Course or any part of a Suspended VET Course;
  4. That the Applicant not cause to be published or broadcast an advertisement relating to a Suspended VET Course or any part of a Suspended VET Course;
  5. That the Applicant not do anything for the purpose of recruiting or enrolling overseas students or intending overseas students in a Suspended CRICOS Course;
  6. That the Applicant not solicit or accept any money from an overseas student or an intending overseas student for a Suspended CRICOS Course; and
  7. That the Applicant will not permit a student to begin a Suspended CRICOS Course if an accepted student has not begun the Suspended CRICOS Course.
