On 11 September 2017, the Tribunal made a decision in accordance with the terms of agreement. Terms of agreement signed:

  1. That the course TLI31210 Certificate III in Driving Operations not be suspended from the Applicant's scope of registration at this time;
  2. That a condition be imposed on the applicant's registration (see new entry for condition)​

and  agreement for:

  1. The Applicant withdraws its application to amend its scope of registration to add TLI31216 Certificate III in Driving Operations;

The Commissioner Risk, Intelligence and Regulatory Support decided to:

  1. Suspend, under the NVR Act s 36(2)(e) and s 38 the following part of the RTO's scope of registration (or impose a sanction of lesser severity):
    1. TLI31210 Certificate III in Driving Operations (superseded); and
    2. any new training package product that would be automatically added to the scope of registration because it is equivalent to the one which appears above; and
  2. during the suspension require, under the NVR Act s 38(2), the RTO (not) to:
    1. enrol a student in a suspended VET course or part of a suspended VET course;
    2. allow a VET student to begin a suspended VET course or part of a suspended VET course;
    3. Publish or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course; or
    4. cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course.
