Review information
Following reconsideration, the Chief Commissioner and the Commissioner, Risk Intelligence and Regulatory Support decided to affirm the decision.
The provider has applied to the Administrative Appeals Tribunal (AAT) for a review and stay of the decision.
The decision has been stayed by the AAT subject to the following conditions:
- the Applicant retain all records of re-assessment of students for the duration of the review proceedings; and
- the Applicant maintain and produce on request to ASQA, class rolls for each class, signed by each student required to attend that class and each trainer/assessor training or assessing in that class for all courses on its scope of registration under the NVR Act and the ESOS Act.
Following AAT review, the parties reached an agreement.
The Tribunal decided:
ASQA's decision to reject, under s 17 of the NVR Act, the part of the applicant's application for renewal of registration as a NVR RTO as outlined above is set aside, and in substitution:
- That part of the applicant's application registration for renewal is granted with immediate effect until 31 October 2025.
