Following AAT review, the parties reached an agreement as to the terms of a decision of the Tribunal.

The Tribunal decided to set aside ASQA's decision and in substitution, decided to:

1. 1. grant, under section 17 of the NVR Act, the Applicants application for renewal of registration as an RTO with immediate effect for a period of four years from the date of the Tribunal's decision
   2. for the purpose of paragraph 18(c)(i) of the NVR Act the Applicant's scope of registration is:
      • BSB40215 Certificate IV in Business
      • BSB50215 Diploma of Business
      • BSB50815 Diploma of International Business
      • BSB51915 Diploma of Leadership and Management
      • BSB60215 Advanced Diploma of Business
      • BSB61015 Advanced Diploma of Leadership and Management
      • CPC30611 Certificate III in Painting and Decorating
      • CPC50308 Diploma of Building and Construction (Management)
      • ICT40115 Certificate IV in Information Technology
      • ICT50115 Diploma of Information Technology
   3. impose, under subsections 17(6) and 29(1) of the NVR Act the following conditions on the Applicant's registration:

For the entire period of its current registration, the Applicant must securely retain, and provide to ASQA on request, copies of all completed student assessment items for each student (per the definition in ASQA's General Direction – Retention requirements for completed student assessment items and clearly identifiable as to which student and unit/s each item relates to) and copies of the master assessment tools used for each assessment, for a period of 12 months from the date on which the judgement of competence for each relevant unit of competency is made.
