The Commissioners decided to:
i. suspend, under the NVR Act s 36(2)(e) and s 38 all of the RTO's scope of registration;
ii. during the period of suspension, require, under the NVR Act s 38(2) the RTO not to:
- enrol a student in a suspended VET course or part of a suspended VET course;
- allow a VET student to begin a suspended VET course or part of a suspended VET course;
- publish or broadcast an advertisement relating to a suspended VET course or part of a suspended VET course;
- cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course.
with effect 35 calendar days after the date the RTO is given written notice of the decision.

Review information

The decisions have been stayed subject to the following conditions:

  1. The Applicant must not enrol any new students into any course, or part thereof, on its scope of registration on or after 1 June 2019;
  2. The Applicant must:
    1. Advise any new students, who enrol on or after the date of this stay order, in writing, of the following notice (to be signed by each new student): “Ayurveda College Pty Ltd is currently in proceedings before the Administrative Appeals Tribunal concerning a decision made by the National VET Regulator (the Australian Skills Quality Authority) to suspend its registration as a registered training provider. The suspension decision has been stayed by order of the Tribunal dated 14 December 2018, meaning the college can continue to operate and deliver VET courses to domestic and international students as usual."; and
    2. Provide copies of the signed noticed to ASQA or the Tribunal upon request.

Note: On 22 November 2019 the AAT varied the stay order to remove the following condition:

  1. The Applicant must not enrol any new students into any course, or part thereof, on its scope of registration on or after 1 June 2019.
