The Commissioner, Regulatory Operations decided to:

  1. Suspend, under the NVR Act s 36(2)(e) and s 38
    1. all the RTO’s scope of registration
  2. during the period of suspension require, under the NVR Act s 38(2), the RTO not to:
    1. enrol a student in a suspended VET course or part of a suspended VET course
    2. allow a VET student to begin a suspended VET course or part of a suspended VET course
    3. publish or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course, or
    4. cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course

with effect 35 calendar days from the date the RTO is given written notice of the decision

Additional information

​Following AAT review, the parties reached an agreement.

It was decided that:

  1. the decision to suspend is set aside and in substitution the RTO registration is not suspended
  2. The following condition is imposed on the providers registration under s29(1) of the NVR Act for a period ending 29 August 2023:
    • Every six months (6) commencing from 29 August 2020, the RTO must conduct an internal audit of its operations as an RTO to review its compliance with the Standards for Registered Training Organisations (RTOs) 2015:
      • An internal audit report must be prepared, setting out the internal audit findings. Copies of all internal audit reports must be retained and presented to ASQA on request.
      • For the internal audit conducted on or around 29 February 2023, the Applicant must retain, and present to ASQA on request, copies of all documents referred to in the associated internal audit report. These documents may be considered as part of any future application to renew registration.
