The Commissioner Regulatory Operations decided to:

1. impose, under the NVR Act s 29(1), the following conditions on the RTO's registration:
2. for all delivery and/or assessment of TAE50116 Diploma of Vocational Education and Training, and any new training package product that would be automatically added to the scope of registration because it is equivalent to the one which appears above, Amy Boleszny Pty Ltd is required to:
   
   1. provide notice to ASQA, no less than thirty (30) days prior to its intention to commence training and/or assessing learners other than those listed below:
      • existing trainers and assessors in RTO/TAFE who hold the TAE40110/40116 and at least three years of professional practice;
      • existing trainers and assessors who hold a higher-level qualification in adult education with at least three years of professional practice;
      • existing trainers and assessors from industry who are required to hold the TAE40110/TAE40116 with at least three years of professional practice;
      • industry trainers who hold the following skills set may also apply with at least three years of experience; TAESS00003 or TAESS00015 Enterprise Trainer and Assessor Skill Set; and on request, provide to ASQA the training and assessment strategies it intends to implement; and
   2. retain all completed learner assessment items and all versions of all assessment master tools used for all TAE training products on scope of registration for a period of two (2) years from the date of assessment for the relevant unit of competency completed and provide these to ASQA on request.
