Following AAT review, the parties reached an agreement.

The parties agree that the Tribunal set aside the decision and in substitution:

1. The applicant’s registration under the NVR Act is not cancelled;
2. Impose, under s 29 of the NVR Act, the following conditions on the applicant's registration:
   • The applicant must maintain attendance records for all students, and make those records available to ASQA within 14 days on request, for a period of 24 months, commencing on 23 January 2020;
   • The applicant must retain, and provide to ASQA within 14 days upon request, copies of student files, including copies of all:
     1. Marked assessment records (including any document which informed a determination of competence)
     2. Master assessment tools
     3. Learner and trainer guides
     4. Training and assessment strategies
     5. Pre-enrolment forms (including any document which informed whether the student's English language proficiency, educational qualifications, or work experience is sufficient to enable any learner to enrol in a course).
        
        
        
        For a period of 12 months commencing on the date on which a student is issued with a qualification for a period of 24 months, commencing on 23 January 2020;
   • The applicant must review its assessment system against clause 1.8 of the Standards, and conduct validation and moderation of select training products on its scope of registration, being:
     1. BSB51918 Diploma of Leadership and Management
     2. CHC50113 Diploma of Early Childhood Education and Care
     3. HLT54115 Diploma of Nursing
     4. SIT30816 Certificate III in Commercial Cookery
     5. SIT50416 Diploma of Hospitality Management.
        
        
        
        And any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above; by 1 September 2020, and in accordance with the requirements with clauses 1.9 and 1.11 of the Standards.
        
        The moderation must sample a minimum of 10 completed student files for each selected training product on its scope of registration.
        
        A report must be produced of the moderation findings for each student file, including primary evidence of any gap training or reassessment conducted, refunds provided, qualifications cancelled, and evidence of the outcome of any recommendations made as a result of the moderation activity. These reports must be retained by the applicant, and made available to ASQA on request, for a period of 24 months, commencing 1 September 2020.
