​Following AAT review, the paties reached an agreement.

The decision is set aside and in substitution, the following part of the RTO's registration is suspended under s 36(2)(e) of the NVR Act:

  • CHC30113 Certificate III in Early Childhood Education and Care;
  • CHC43015 Certificate IV in Ageing Support;
  • CHC50113 Diploma of Early Childhood Education and Care;
  • TLI31616 Certificate III in Warehousing Operations;
  • FBP30117 Certificate III in Food Processing; and
  • any new training package product that would be automatically added to the scope of registration because it is equivalent to one which appears above; and

During the period of suspension, the RTO is required, under section 38(2) of the NVR Act, not to:

  • enrol a student in a suspended VET course or part of a suspended VET course;
  • allow a VET student to begin a suspended VET course or part of a suspended VET course;
  • publish or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course; or
  • cause to be published or broadcast an advertisement relating to a suspended VET course or any part of a suspended VET course.

Note: The decision was affirmed following reconsideration.

    1. BSB40315 Certificate IV in Customer Engagement
    2. CHC30113 Certificate III in Early Childhood Education and Care
    3. CHC43015 Certificate IV in Ageing Support
    4. CHC50113 Diploma of Early Childhood Education and Care
    5. TLI31616 Certificate III in Warehousing Operations
    6. FBP30117 Certificate III in Food Processing

with effect 35 calendar days after the date the RTO is given written notice of the decision.
