Additional information: 

Following AAT review, the parties reached an agreement as to the terms of a decision of the Tribunal.

The Tribunal decided that:

  1. The decision to reject the applicant's application for renewal of registration as an RTO is set aside;
  2. In substitution:
    1. the Applicant's RTO registration is renewed for a period of four (4) years, commencing from the date of the Tribunal's decision; and
    2. the following two conditions are imposed on the Applicant's RTO registration under section 29 of the NVR Act, commencing from the date of the Tribunal's decision:
      1. the Applicant must securely retain, and provide to ASQA on request, copies of all completed student assessment items for each student (per the definition in ASQA's General Direction – Retention requiremen ts for completed student assessment items) and copies of the master assessment tools used for each assessment, for a period of 12 months from the date on which the judgement of competence for each relevant unit of competency is made; and

the Applicant must monitor and review its compliance in accordance with a Compliance Program.
